3. Real Estate and the Decedent’s Interest at Death

K.S.A. 59-2247(3) asks for the real estate and the decedent’s interest in it at the time of death. The figures below are the inventory’s own date-of-death values, not current ones. The interest itself (fee simple, a life estate, a fractional share, and so on) is ruled for the preparer. A parcel sold during administration still belongs on this list, because the question is what the decedent owned at death; the sale itself appears in the account above, and there is nothing left for the decree to assign. A parcel found after the inventory belongs here too, at the value you recorded for it, since no date-of-death appraisement was ever made.

5. Medical Assistance Statement

K.S.A. 59-2247(5). The record cannot know which branch applies, so both are ruled below; mark the one that is true.

Neither the decedent nor a predeceased spouse of the decedent was paid medical assistance under K.S.A. 39-709.

The state agency that provided medical assistance to the decedent or a predeceased spouse of the decedent was notified of this petition as required by K.S.A. 59-2222.

The Hearing

At the hearing, the personal representative shall, and any other person interested in the estate may, be examined on the account and the proposed distribution. If the account is found correct and the taxes are paid so far as the funds of the estate allow, the account is settled and allowed, and the decree names the heirs, devisees and legatees, describes the property, and states each one’s share (K.S.A. 59-2249).

Notice

Nine months from the personal representative’s appointment is the ordinary period for settlement, and the court may extend it for cause (K.S.A. 59-1501). Notice of the hearing on this petition runs under K.S.A. 59-2208, or, where title to real estate is assigned, under K.S.A. 59-2209: publication once a week for three consecutive weeks, the hearing not earlier than ten nor later than thirty days after the last publication.

Compensation

K.S.A. 59-1717 allows the fiduciary such compensation for services, and for the services of the fiduciary’s attorney, as is just and reasonable, on application to the court. Kansas sets no percentage and no schedule for either, in one section that covers both. Nothing here computes a figure.

Compensation recorded to the personal representative: $9,400.00

The remainder, including any attorney fee, is the court’s to allow.

Verification

Executed in Kansas: “I declare (or verify, certify or state) under penalty of perjury that the foregoing is true and correct.”

A notarized affidavit remains available in place of either declaration, and some offices still expect one. Confirm which your own district accepts.
