The Closing Statement

IC 29-1-7.5-4

This account is not the document filed with the court. Instead, no earlier than three months after the first published notice to creditors, the personal representative files a closing statement. If no proceeding involving the personal representative is then pending, the estate closes by operation of law three months after that filing, and the appointment ends with it (IC 29-1-7.5-4(b)). The closing statement recites, among other things:

  • that notice to creditors was published and the time to file claims has passed;
  • that the estate’s debts, taxes and expenses of administration have been paid, provided for, or otherwise settled;
  • that the assets of the estate have been distributed to the persons entitled to them; and
  • that this account has been furnished in writing to the distributees whose interests are affected, or that they have waived it in writing.

Marion County MSCPR 406.7: in an unsupervised estate the court will not issue an order approving a closing statement or an order discharging the fiduciary. Filing the closing statement, and the passage of time, close the estate. Nothing in this account or in that statement is a claim of court approval.

Notes

  • Indiana publishes no form for this account. Marion County MSCPR 411.1 requires this three-schedule format and rejects an informal, handwritten or transactional accounting.
  • An in-kind distribution’s value is fixed by IC 29-1-17-10(a) at a time not more than ten days before the petition for distribution is filed. The figure shown above is the estate’s own carried value; confirming the ten-day value is the preparer’s.
  • If the will provides for the personal representative’s compensation, that provision is the full compensation unless it was renounced in writing before qualifying. Otherwise compensation is what the court finds just and reasonable (IC 29-1-10-13). Indiana sets no percentage schedule either way, so no commission is computed here.
  • No Indiana inheritance tax line appears in this account: the tax is repealed for deaths after December 31, 2012 (IC 6-4.1-12-0.5).
